We must make sure that detailed Job descriptions are prepared across the all departments. The HR manager should entrust the responsibility to the executives looking after different departments. The executive should carry out a job interview for specific job holders to prepare a detailed and appropriate job description. Along with job description the employees should be provided the KRA or key result areas, so that the employees can understand the parameters based on which they can be judged. The organization must have a proper performance management system. This will not only help the employees identify strengths and areas of developm ent, but also help the employees to understand how they could contribute towards the success of the organization in future. One the major problems faced by the organization has been attrition. Therefore to diagnose the problem we should ensure that there is a structured salary, increment and recognition system. It should be made clear to the employees that the increments would be performed based on the findings of the performance management system. Also to motivate the employees there would be existence of reward and recognition system. This would include both monetary as well as non monetary rewards. During the meeting with the employees and managers, some key players should be identified. Those employees could be granted Employee Stock Option Plan (ESOP). During the meeting with the employees we found out that there is a need for training, especially for the people who are at constant touch with the customers. For, example customer services reps and sales & marketing professionals . Hence, the corporate team may identify a relevant training partner to impart training. The Vile Bodies Essay example -- Literary Analysis, Evelyn Waugh

The postwar England of the twenties and thirties was the setting of Evelyn Waugh’s first satirical novels, among which was the Vile Bodies. Waugh, an author mostly known for his highly satirical fiction, published his novel Vile Bodies in 1930 right in the middle of the time-period between the Great Wars. Because of the historical evens that occupied England at that time, much of British Literature of the late 1920’s and early 1930’s was concerned with the Modernist movement, which was occupied with the idea of individualism of the young generation. Through the use of prominent and yet highly satirical characters, Waugh strives to criticize his Modernist generation for its unsuccessful movement into Modernism, both on the individual and political/institutional level. He does so by defining his type-characters as ignorant, self-centered and hypocritical in their disastrous movement toward individualism. Through the use of satire, the issues presented by Waugh in Vile Bodies become greatly influenced by the time period in which the novel was written. Great Britain, in the late 1920’s and early 1930’s, was placed on the time line between the Great Wars. Thus, the novel’s placement in the history shifts its focus not only toward the emergence of the World War II but also on the depressed postwar economy of Britain at the time. Some of the most prominent ideas evolving during this period of time were embracive of the idea of change in areas such as religion, science, art, social rules, literature and economic and political conditions—changes that most often led to a feeling of â€Å"loss of community† (Wellman, 327). Because of the nature and the ongoing changes during this period the idea of modernism also played a major role in Britis... ...the importance placed on individualism. For, although he †blinkingly accepts whatever outrageous turn of fortune [he] may encounter† (Twayne, 43) he is still the only character that displays a feeling on emptiness and disillusionment about the constant search of amusement that is seen in all the other characters. Adam questions the generation’s way of living â€Å"do you ever feel that things simply can’t go on much longer† and states that he would â€Å"give anything in the world for something different† (Waugh, 273). Furthermore, he even goes as far as criticizing the never-ending parties and games as â€Å"succession and repetition of massed humanity†¦ those vile bodies†¦Ã¢â‚¬  (Waugh, 171). Although Adam seems to have glimpses of understanding the destruction that this generation is causing, nonetheless, he feels stuck in the vicious cycle that is created by this lifestyle.

Life Is so Good

Shauntral Pollard Mrs. Judice English 1302. 02 March 6, 2013 Life Is So Good Test George copes with his illiteracy with a positive attitude. An incident happened when George was trying to board a train, but he wasn’t able to because his ticket was only a one-way travel. The ticket master said to him, â€Å"read the ticket† and after this incident I believe George’s view toward learning changed. I believe George would have been a great scholar because of how he was able to obtain knowledge by watching and listening.He would even recall life lessons his father and mother taught him as he encountered different situations. George’s advantage in life was he was able to travel and his father raised him to be a responsible man. Although he came from a poor family, George was very hard working and responsible. George was rich with common sense and humbleness. He never stepped over his boundaries and did whatever he was asked of him, never complaining and doing his entire jobs well. The students were drawn to George because he had been all over the country and he was very wise.George was 100 years old and he had a knowledge base one could only hope to gain. He would always be to school early ready to learn and I believe his eagerness to learn inspired young and old. The advice George’s father gave him made realize every person is different. He should not judge a person because of all the hardships he and his family had to face growing up in the South. I think his father wanted to keep George focused so his state of mind would not have him thinking he was better than another person.Although George had a lot of good and bad experiences, he still remained modest and friendly. George would answer the question, †What makes life worth living? †, by saying each person makes his or her own life worth living. A person will either make life hard or easy. George’s life was so good because he had all he needed and his life was f ull of great experiences. George truly enjoyed aspect of life and did not worry about what life had to bring his way. He really was a great human being and many of us could take a life’s lesson from him on how to be genuine on how to treat others who are different.To George, it did not matter what background a person came from because their actions would speak louder than words. When George said, â€Å"there are some parents these days that are growing children, not raising children, â€Å"I believe he meant the children now are being raised by the television, game systems, or the internet. I totally agree with him because when I grew up we had to spend time either listening to our parents or had a time when we had to go outside the house and play. Parents need to become more involved in their children’s lives and not allow the digital age to be the supervisors.George Dawson’s attitude impacted his life in a major way. He knew he could not change the laws or t he way people felt, so he decided not be angry. People who have a positive attitude are able to have a great lives and that is what George did. His humble attitude kept him from getting into trouble or being around the wrong person. Most people would have been miserable or depressed because of the type of life George had to lead. But not George, he remained the same until the end.

There are many long-term results that come from having that piece of paper that has your degree on it. Almost all job markets out there in the world today require training with a higher education due to all the upgrades in technology that has come about. For me, the value of getting my degree means that I will be able to contribute to my family income along with my fiancà ©e. I will be helping to provide a better way of living for my children and ourselves. I will finally be able to go to a job that I worked so hard to go to. All of the studying and assignments that I am having to go through right now is just a stepping stone to my future career. I am hoping that by me going back to school and getting my degree will help influence my own kids to want to make themselves better when they grow up. I want to be a positive role model and show them that they too can go to college and make a better life for them. All of the asse ssments and tools that are provided for us in this online learning environment are great and can be helpful to each of us for our future courses and future careers. I never knew all the activities that we have worked on in this course would show me things that I never knew about myself. My aptitude test and ethical lens inventory showed me the kind of personality I have in words. I knew things about myself but seeing them in writing is kind of a different view of it all. Building my career path is also something that helped me to find out what kind of career choices are out there that I had not even began to think would be something that I might want to do when I graduate as well. Going into college, my mindset was completely focusing on healthcare administration and that was it. Now I see what other careers there are available to use my degree with. It showed me that there are much more careers that involve working with the public besides working in a doctor’s office or hospital. Learning in this collaborative environment with all these other students is really a wonderful opportunity for me. I enjoy being able to type my responses to my fellow classmates and hear back from them. It teaches us to be more aware of others on a different level than being together in a physical classroom. Instead of being in a class with students your own age, you are with a variety of age groups in a collaborative online learning environment. This allows more diversity and different points of view from all kinds of people. There are many people that have so many different experiences and we can all learn from them. This course has also helped to teach me a little more about time and stress management. A Guide on How to Use Adverbial Clauses of Time Adverb clauses provide additional information about how something is done. They are much like adverbs in that they tell the reader when, why or how someone did something. All clauses contain a subject and a verb, adverb clauses are introduced by subordinating conjunctions. For example, Tom helped the student with the homework because he didnt understand the exercise. ... because he didnt understand the exercise explains why Tom helped and is an adverb clause. Begin by studying adverb clauses which are often called time clauses in English grammar books and follow specific patterns.   Punctuation When an adverb clause begins the sentence, use a comma to separate the two clauses. Example: As soon as he arrives, we will have some lunch. When the adverb clause finishes the sentence, there is no need for a comma. Example: He gave me a call when he arrived in town. Adverb Clauses with Time When: He was talking on the phone when I arrived.When she called, he had already eaten lunch.I washed the dishes when my daughter fell asleep.Well go to lunch when you come to visit. When means at that moment, at that time, etc.. Notice the different tenses used in relation to the clause beginning with when. It is important to remember that when takes either the simple past OR the present - the dependent clause changes tense in relation to the when clause. Before: We will finish before he arrives.She (had) left before I telephoned. Before means before that moment. It is important to remember that before takes either the simple past OR the present. After: We will finish after he comes.She ate after I (had) left. After means after that moment. It is important to remember that after takes the present for future events and the past OR past perfect for past events. While, as: She began cooking while I was finishing my homework.As I was finishing my homework, she began cooking. While and as are both usually used with the past continuous because the meaning of during that time  indicates an action in progress. By the time: By the time he finished, I had cooked dinner.We will have finished our homework by the time they arrive. By the time expresses the idea that one event has been completed before another. It is important to notice the use of the past perfect for past events and future perfect for future events in the main clause. This is because of the idea of something happening up to another point in time. Until, till: We waited until he finished his homework.Ill wait until you finish. Until and till express up to that time. We use either the simple present or simple past with until and till. Till is usually only used in spoken English. Since: I have played tennis since I was a young boy.They have worked here since 1987. Since means from that time. We use the present perfect (continuous) with since. Since can also be used with a specific point in time. As soon as: He will let us know as soon as he decides (or as soon as he has decided).As soon as I hear from Tom, I will give you a telephone call. As soon as means when something happens - immediately afterward. As soon as is very similar to when it emphasizes that the event will occur immediately after the other. We usually use the simple present for future events, although present perfect can also be used. Whenever, every time: Whenever he comes, we go to have lunch at Dicks.We take a hike every time he visits. Whenever and every time mean each time something happens. We use the simple present (or the simple past in the past) because whenever and every time express habitual action. The first, second, third, fourth, etc., next, last time: The first time I went to New York, I was intimidated by the city.I saw Jack the last time I went to San Francisco.The second time I played tennis, I began to have fun. The first, second, third, fourth, etc., next, last time means that specific time. We can use these forms to be more specific about which time of a number of times something happened. Adverb  Clauses Showing Opposition These type of clauses show an unexpected or non-self-evident result based on the dependent clause. Example:  He bought the car even though it was expensive. Take a look at the chart below to study the various usages of adverb clauses showing opposition. Punctuation: When an adverb clause begins the sentence use a comma to separate the two clauses. Example:  Even though it was expensive, he bought the car. When the adverb clause finishes the sentence there is no need for a comma. Example:  He bought the car even though it was expensive. Even though, though, although: Even though it was expensive, he bought the car.Though he loves doughnuts, he has given them up for his diet.Although the course was difficult, he passed with the highest marks. Notice how though, even though or although show a situation which is contrary to the main clause to express opposition. Even though, though and although are all synonyms. Whereas, while: Whereas you have lots of time to do your homework, I have very little time indeed.Mary is rich, while I am poor. Whereas and while show clauses in direct opposition to each other. Notice that you should always use a comma with whereas and while. Using Adverb Clauses to Express Conditions These type of clauses are often called if clauses in English grammar books and follow conditional  sentence patterns. Take a look at the chart below to study the various usage of different time expressions. Punctuation: When an adverb clause begins the sentence use a comma to separate the two clauses. Example:  If he comes, we will have some lunch.. When the adverb clause finishes the sentence there is no need for a comma. Example:  He would have invited me if he had known. If: If we win, well go to Kellys to celebrate!She would buy a house, if she had enough money. If clauses express the conditions necessary for the result. If clauses are followed by expected results based on the condition. Even if: Even if she saves a lot, she wont be able to afford that house. In contrast to sentences with if sentences with even if show a result that is unexpected based on the condition in the even if clause.  Example:  COMPARE: If she studies hard, she will pass the exam AND Even if she studies hard, she wont pass the exam. Whether or not: They wont be able to come whether or not they have enough money.Whether they have money or not, they wont be able to come. Whether or not expresses the idea that neither one condition or another matters; the result will be the same. Notice the possibility of inversion (Whether they have money or not) with whether or not. Unless: Unless she hurries up, we wont arrive in time.We wont go unless he arrives soon. Unless expresses the idea of if not  Example:  Unless she hurries up, we wont arrive in time. MEANS THE SAME AS: If she doesnt hurry up, we wont arrive in time.  Unless is only used in the first conditional. In case (that), in the event (that): In the case you need me, Ill be at Toms.Ill be studying upstairs in the event he calls. In case and in the event usually mean that you dont expect something to happen, but if it does... Both are used primarily for future events. Only if: Well give you your bicycle only if you do well on your exams.Only if you do well on your exams will we give you your bicycle. Only if means only in the case that something happens - and only if. This form basically means the same as if. However, it does stress the condition for the result. Note that when only if begins the sentence you need to invert the main clause. Adverb Clauses with Expressions of Cause and Effect These type of clauses explain the reasons for what happens in the main clause.  Example:  He bought a new home because he got a better job. Take a look at the chart below to study the various usages of different expressions of cause and effect. Note that all of these expressions are synonyms of because. Punctuation: When an adverb clause begins the sentence use a comma to separate the two clauses.  Example:  Because he had to work late, we had dinner after nine oclock.. When the adverb clause finishes the sentence there is no need for a comma.  Example:  We had dinner after nine oclock because he had to work late. Adverb Clauses of Cause and Effect Because: They received a high mark on their exam because they had studied hard.Im studying hard because I want to pass my exam.He works a lot of overtime because his rent is so expensive Notice how because can be used with a variety of tenses based on the time relationship between the two clauses. Since tends to be used in more informal spoken English.  Important note:  Since when used as a conjunction is typically used to refer to a period of time, while because implies a cause or reason. As long as: As long as you have the time, why dont you come for dinner? As long as means the same as because. As long as tends to be used in more informal spoken English. As: As the test is difficult, you had better get some sleep. As means the same as because. As tends to be used in more formal, written English. Inasmuch as: Inasmuch as the students had successfully completed their exams, their parents rewarded their efforts by giving them a trip to Paris. Inasmuch as means the same as because. Based on this theory, leaders evaluate specific situations and their actions would be based on these situations they face (Bolden, et.al., 2003). Under these conditions, the situation, the leader, and the follower are part of the theory. The Pazzi Conspiracy Essay Abstract: On a sunny Sunday in April of 1478, assassins from the Pazzi family attacked Lorenzo de’ Medici and his brother Giuliano. Giuliano lay bleeding on the cathedral floor, and later bled to death. Lorenzo, however managed to get to safety—not a good thing for the Pazzi family. Up to this point the Pazzi clan had been considered one of the most noble and well-respected clans. They were financiers who â€Å"feared and resented the Medici’s swaggering new role as political bosses. † 4 This failed assassination attempt doomed the Pazzi family. The Medici’s put forth swift and brutal revenge. Each of the Pazzi family who had taken part in the assassination attempt was either hanged or beheaded, and the bodies were hung from the windows of the governmental palace. As if this wasn’t punishment enough, the Pazzi’s were forced to change their surname. Every remnant of evidence that the Pazzi family had once been a well-respected clan was wiped out by the Medici’s. 4 It was Easter Sunday within the Cathedral of Santa Maria del Fiore. The Priest was just bringing the Mass to a close, when assassin’s attacked the de’Medici brothers, Lorenzo and Giuliano, brutally stabbing them. Giuliano was stabbed a horrifying nineteen times, and the blood drained from his body right there on the cathedral floor. Lorenzo, however, was stabbed only once in the neck, a cut that apparently missed any major arteries, and he fought his attackers with all his might until he got free and ran away to hide. 5 Of course there was chaos within the cathedral, and some brave soul ran to pull the bell pull to send out a distress call and summon other Florentines to help ward off the coup attack taking place within the cathedral walls. Shortly thereafter every church in Florence was also tolling their bells, call the men of Florence to â€Å"defend their Republic.† Who were these Medici’s who had taken control of their government? It is believed that they were descendants of apothecaries—today’s pharmacists—and were relatively unknown in the 14th century. Giovanni Medici was the mastermind of the family and his business acumen and sheer boldness brought the Medici family from the shadows directly to the forefront of the political world in Florence. 6 Giovanni was one of five sons. He lived with their mother, a poor widow woman. A wealthy cousin of Giovanni’s acquired a position for Giovanni as an employee of the Medici Bank in Rome, and it was not long before Giovanni, demonstrating his boldness and business prowess, moved straight to the top in the bank, actually displacing his own cousin. Giovanni was a blatant risk taker, and began laundering money for Baldasarre Cossa, commonly known as a pirate. Giovanni even went so far as to put up the money to allow Cossa’s bid for the Papacy, and in 1410 Cossa was actually elected Pope John XXIII. Of course the former pirate felt obliged to reward his good friend Giovanni by making the Medici family the new Papal Bankers. Giovanni became known as â€Å"God’s Banker.† This turned out to be quite a lucrative venture for both parties involved—the former pirate, and the former nobody who rose to such a high position. The Medici bank received a hefty ten percent of everything the Church brought in. At this time in history there was a rather unscrupulous debt collection service run by the church itself. If people didn’t pay, they were promptly excommunicated, a very powerful motivator. Soon the Medici family were the third wealthiest family in Florence, much to the dismay of the older, more established families who saw the Medici family as money-grubbing interlopers. Giovanni Medici soon built an entire network of thugs and thieves who both demanded and rewarded unconditional loyalty. He set up the banks so the managers shared a stake in their bank, and even banned loans to Kings or Princes, as he felt they were absolutely the worst risks. He often advised his descendants to â€Å"Always keep out of the public eye—never show pride.† 6 It would have been better for all involved if they had taken this advice to heart. Giovanni’s son, Cosimo de Medici was trained from a very early age to take over the banking empire from his father. Cosimo was a dedicated learner, â€Å"studying classic texts, attending lectures and becoming one of the first generation of Humanists. Cosimo urged his father to turn the family’s wealth to civil patronage.† 6 When Cosimo inherited the position of Capo from his father, the Albizzi family, another wealthy, powerful, family made up treason charges against him out of sheer jealously and Cosimo was actually sentenced to death for these false claims. Luckily he bribed his way from prison and hid out for a while, later returning to Florence more powerful than ever. However, shortly after Cosimo returned, he was attacked in a dark alleyway and his attackers cut his face from ear to ear. He lived, but bore the scars known as â€Å"che brutta figura†, which translates into â€Å"revenge through humiliation.†6 Cosimo, much like his own father well understood how politics and power worked. His own advice to his heirs, which was much like his father’s advice to him was, â€Å"Do not seek power. Wait until they call you.† Cosimo had two sons, Giovanni and Piero. Giovanni was certainly his father’s favorite, and was obviously being groomed to take over the family business while Piero was sickly, and stayed out of the public limelight because of his ill health. Piero devoted himself to learning, and became well-respected as a diplomat. In fact, King Louis XI had such a high opinion of Piero that he gave him the specially bestowed honor of â€Å"permitting Piero to stamp the lilies of France on one of the balls of the Medici arms—this one ball colored blue for that purpose.† 6 When Piero’s brother Giovanni died unexpectedly, Cosimo began grooming his grandson, Lorenzo to take over because he felt Piero’s health was unstable and that he couldn’t handle the job. Piero had two sons, Lorenzo and Giuliano. Lorenzo, at the tender age of seventeen was well known for his courage and boldness, â€Å"single-handedly foiling a Pitti family plot to assassinate his father Piero.† 6 Lorenzo was indeed well educated in banking and diplomacy in order to follow in the family footsteps, but he apparently also had a lust for the other side of life; wine, women and song.   He married at nineteen and fathered seven children, two of them adopted. Lorenzo was a patron of the arts and promoted such artists as Bottcelli and Leonardo DeVinci, even going so far as to take a young Michelangelo into his own home and â€Å"raising him like a son.† 6 Lorenzo’s trademark phrase was somewhat different from that of his father and grandfather: â€Å"He who wishes to be happy let him be so, for of tomorrow there is no knowing.† Giuliano de Medici was Lorenzo’s younger brother, and shared Lorenzo’s passion for life. He fathered an illegitimate child in his youth, and when he was murdered on that fateful Easter Sunday Lorenzo later adopted that son. While Giuliano loved his older brother, there was also some natural resentment involved in their relationship. As for the Pazzi family, consider this heritage: â€Å"During the First Crusade in 1088, as Christian soldiers scaled the walls of Jerusalem, a fighter named Pazzo Pazzi was the first man over the top. Pazzo was often known as â€Å"the madman.† 11 As a reward for his courage, he was gifted three small stones from the Holy Sepulcher.† 7 The Pazzi were an old Florentine family, and two of the family members were even named in â€Å"Divine Comedy,† by Dante. There were also boasts of having a knight in each generation. The Pazzi arms which reflected their long and noble history contained â€Å"crescents, battlement towers and twin dolphins on a blue field with nine crosses.† 7 The arms represented Christian faith, generosity and freedom, and the Pazzi’s displayed it proudly. Andrea de Pazzi entered into banking in the fourteenth century. He was a sharp businessman and quickly amassed a fortune. However, being one of the â€Å"grande† names in the area they were excluded by Florentine law from participating in their own government. Because of this law, Andrea decided to relinquish the status of â€Å"grande† and give his own sons the opportunity to hold public office. 7 During a visit in 1443 by Pope Eugene IV to the Pazzi family, the Pope made a deposit of 4000 florin into the Pazzi bank, showing that there were â€Å"Papal accounts that could be pried away from Medici control.† Andrea left three sons, Antonio, Piero and Jacopo, all of whom were well-educated in the banking trade and all of whom held a large fortune and extensive assets. Jacopo was the only son who would live long enough to â€Å"become enmeshed in the conspiracy to assassinate the Medici brothers.† 7 Interestingly, however, Jacopo happened to also be a strong supporter of Piero de’ Medici, Lorenzo’s father. Jacopo was known throughout for his great generosity to the poor, and although he began as an observer, he eventually allowed his nephew, Francesco, son of Antonio, to draw him into the assassination plot. Francesco, Jacopo’s nephew was known as â€Å"diminutive, pale and driven,† but apparently he harbored great resentment for the Medici’s, in fact it soon became apparent to all that his hatred of the Medici’s had overtaken every aspect of his life, and even allowed him to conveniently forget that he was in fact related to the Medici through marriage. 7 This urgency that Francesco displayed, along with his intense hatred for the Medici clan became the driving force for the assassination plot. So, now we know about the Medici clan and the Pazzi clan. The other factor in this triangle were the Pope and his court. The conspiracy planned by the Pazzi actually had the blessing of the church because Pope Sisto IV â€Å"contemplated to demolish the dominion of Medici and for this purpose he sustained the groups led by Pazzi’s family which had replaced de Medici in the office of bankers.† Francisco della Rovere was destined from his very childhood for the Franciscan order. 8 On the death of Pope Paul II, he was elected pope and called Pope Sixtus IV. Unfortunately Pope Sixtus used his position as Pope to further his own family members by obtaining political appointments for them. When Lorenzo â€Å"refused Sixtus’ demand on the Medici bank for a loan of 40,000 ducats to purchase the town of Imola,† the conspiracy was set into motion. 8 Sixtus wanted to acquire the town in order to give it to his nephew, Riario. Girolamo Riario was the nephew of Sixtus and was one of the key plotters in the assassination attempt on the Medici brothers. Riario married the daughter of the Duke of Milan, and used this marriage to attempt to sabotage the relationship between the Duke and Lorenzo. â€Å"Riario fueled Francesco de Pazzi’s inner fire by intimating that the Pazzi family would play a large part in the next government of Florence, while coveting the future Dukedom of Florence for himself.† Archbishop Francesco Salviati was born into one of Florence’s most active political families and was related by marriage to the Pazzi, Medici, Vettori, and other very powerful families. 8 Salviati was a â€Å"flatterer, a gambler, and lusted for the power that could be attained through church favour.† 8 He easily became a co-conspirator in the attempted assassinations. Count Riario himself summoned Battista to meet with himself and the Archbishop Salviati. Salviati strongly persuaded the others to agree with him about wanting a â€Å"coup d’ tat in Florence, and Riario and Salviati then outlined what they considered to be Lorenzo’s evil intentions against each of them, telling Battista repeatedly that when the Pope died, Riario and his state would be in grave danger from Lorenzo. 10 Riario and Salviati finally bluntly told Battista that the only thing to do was to â€Å"cut Lorenzo and Giuliano to pieces, to have troops ready in secret, and to go into Florence and do this thing.† 10. Battista was reluctant, believing they were discussing something very big, and he wasn’t sure he wanted to become involved, but the other two were persuasive. Although nobody knew at the time, there were literally hundreds of mercenary troops settled firmly within the borders of Tuscany, â€Å"poised to invade the city at a signal that never came.† It was Salviati and Francesco de Pazzi who masterminded the plot to assassinate Lorenzo and Giuliano. Riario, always working behind the scenes, remained in Rome. Interestingly enough, the plan was hardly a secret, and was fairly widely known. The Pope reportedly even stated that â€Å"I support it—as long as no one is killed.† 11 Rather a silly statement when the plot is an assassination plot. When Lorenzo escaped the assassination attempt, he locked himself in the sacristy. â€Å"A coordinated attempt to capture the Gonfaloniere and Signoria was thwarted when the archbishop and the head of the Salviati clan were trapped in a room whose doors had a hidden latch.† 11 The assassination attempt had failed, and â€Å"enraged Florentines seized and killed the conspirators.† 11 Jacopo Pazzi was tossed from a window, and if that weren’t enough to kill him, he was finished off by the angry mob, then dragged naked through the streets and eventually thrown in the river. 11 The entire Pazzi family were stripped of all their worldly possessions, and every â€Å"vestige of their name effaced.† 11. Salviati, even though he was an archbishop was summarily hanged on the walls of the Pallazo. Lorenzo actually appealed to the crowd to show mercy, but to no avail, as many of the conspirators and even those only accused of being co-conspirators were killed. Lorenzo managed to save the nephew of Sixtus and two other relatives of the plotters, and the main conspirators were hunted down throughout Italy. During the assassination plot, Marsilio Ficino, who was the son of Cosimo Medici’s physician, became important in his own right. In 1478, largely as a result of the war which resulted from the assassination plot, the plague broke out in the city of Florence. Ficino published a very different sort of work; a practical guide to the treatment of the plague, and was written in Tuscan to be readily accessible to his fellow citizens. 12 This work went on to be translated into Latin and published â€Å"alongside Galen’s work on fevers, as a standard medical work. It is easy to forget that all Ficino’s works of profound contemplation and leisurely presentation were written against a backdrop of intense social and political disturbances.† Another player in this era was Caterina Storza, an illegitimate daughter of Galeazzo Maria Sforza who ended up married, at the age of fourteen, to Girolamo Riario, the nephew of Sixtus, and a primary player in the assassination attempt on the Medici family. Caterina came to be known as the â€Å"Machiavellian mother† in Machiavelli’s works. 1 Eventually, after the assassination attempt, the tables were turned and Riario was murdered by a group of conspirators in his own home, just after lunch. The murderous group then took Caterina, her mother, her two half sisters, an illegitimate son of Girolamo’s and her six children, captive. Although the aim of the assassination attempt was to get rid of the Medici family, and show Lorenzo in a bad light, the aftermath of the fateful Easter Sunday actually showed quite the opposite. Lorenzo had kept his head during the entire chaotic episode, and he would show time and time again as things progressed that he was intelligent and calm in the very worst of circumstances. When the conspiracy fell apart, Sixtus was furious and drew up â€Å"an ecclesiastical censure against Florence, withdrawing sacraments and the right to a Christian burial from all the citizens of Florence.† He excommunicated Lorenzo all on his own, which actually had little effect, so he formed a military alliance with King Ferrantes of Naples and began planning an attack on Florence itself. 3 The allies that had previously helped the Medici were not anxious to help the Medici fight the Pope, and even though it seemed there would be another disaster, Lorenzo’s â€Å"brilliant tact,† averted it. â€Å"Switching effortlessly from avenger to peace-maker, he personally traveled to Naples to confer with the King, and an understanding was achieved without resorting to war. From then on Lorenzo became known as the Savior of Florence.† Lorenzo followed closely the policy which was begun by his grandfather Cosimo. He managed to â€Å"maintain a balance of power between the five chief Northern Italian states, forming defensive alliances and thus keeping a check on invasions from foreign powers.† 3 The Medici Bank had been somewhat neglected since Cosimo’s time, as he had turned more and more to politics, and though Lorenzo did his best to turn this around, he found himself, for perhaps the first time in his life, in financial difficulties. To keep himself afloat, â€Å"he resorted to embezzling Public Funds, and it was this that later undermined his rule.† Although we have all been led to believe that â€Å"history belongs to the victors,† it is still very sad to understand that every trace of the Pazzi family, one of Florence’s oldest and most respected families, was wiped out following the attempted coup. 13 â€Å"The Pazzi coat of arms was torn off their buildings. A special governmental commission spent the next two years disentangling Pazzi assets with a view to confiscation. Anyone with the name of Pazzi was forced to change it. Women of the family were forbidden to marry in Florence, which was as good as not allowing them to wed at all. No portrait of any Pazzi adult is known to have survived.†   It is an entire piece of history completely destroyed as a result of one act. The aftermath of the Pazzi Conspiracy continued for many, many years after the event itself. As stated, Lorenzo became something of a hero, despite his embezzlement problems, and when he died at the young age of forty three, there was a â€Å"massive display of public grief and the entire population attended his funeral. He was buried in the Medici Chapel in the Church of San Lorenzo, where his brother Giuliano already rested.† 3 Lorenzo left behind quite a legacy however; his second son Giovanni and his nephew Giulio (the illegitimate son of Giuliano, who had been captured with Caterina after Giuliano’s death) were later to become very powerful popes, Pope Leo X and Pope Clement VII. 3 Works Cited 1. Impact of the Land Registration Act 2002 A registration scheme far more comprehensive than land charges is found today in the Land Registration Act 2002. The principle significance of this is that the register tells the purchaser who owns the legal estate. The system moreover is not limited to legal estates. Subject to some exceptions (overriding interest), all legal and equitable interest must be entered on the register if they are to bind a purchaser.[1] The first thing to ascertain when dealing with any piece of land is which system of conveyancing is to be applied. And it is clear in the scenario that the land is registered.[2]The purchaser will want to know whether any third parties have rights to the land which might interfere with the intended use of it. Concern about these matters will lead the purchaser to make extensive enquiries before the purchase of the estate is finally concluded.[3] A. Legal leases not exceeding seven years constitute overriding interest and this falls under schedule 3, Para 1 of LRA 2002. Short legal leases are specifically excluded by Para 1 from the category of short leases which override registered disposition. That includes leases which are to take effect in possession more than three months after the date of grant.[4] Polly comes to the cottage after Alisha brought it but Polly was given the lease the previous year. And since Alisha didn’t find any belongings in the cottage before buying we can assume that Polly returned after a year to take possession. In that case Sec.4 (1) (d) applies which makes the lease not an overriding interest. Because such leases mean that there is a real risk that the purchaser might buy the estate without discovering that it is subjected to a lease when the tenant is not necessarily in possession of the land. In such scenarios we can conclude that only the facts matters. And if Polly wants her legal lease to be protected knowing that she won’t be in possession of the cottage for some time she should have made a notice[5] in the register about her lease. But certain interests cannot be protected by notice[6] , one such case is when the lease doesn’t exceed more than three years, interest under a trust of land or restrictive covenants. Since Polly’s lease is for four years it can be entered into the charges register. The fact that an interest is the subject of a notice doesn’t mean that the interest is valid. However, if the interest is valid, the notice ensures both that it binds any purchaser for valuable consideration[7] , and he knows about it before he takes the estate.[8] It is therefore much safer to protect such interests by notice. Once such an entry has been made the interest losses its overriding status[9] , but of course binds a disponee for valuable consideration. B. It is essential to remember that, it is the rights of the occupiers that bind purchasers and not the occupation itself. The claimant must always prove two elements: actual occupation and an interest in land. In National Provincial Bank v Ainsworth[10] it was held that deserted wife’s equity to be a mere personal right against her husband; her occupation made no difference.[11] Judges have regularly emphasized that the question of whether a party is in actual occupation is essentially a question of fact. Lord Wilberforce stated that[12], ‘It is the fact that matters and what is required is physical presence on the land and not some entitlement in law’ this was stated in Abbey National v Cann. In LRA 2002 Schedule 3 , Para 2 if occupation is established but the interest claimed was not known to the purchaser , the question will then be whether the occupation was obvious on reasonable inspection of the land.[13] Wilma daily comes home even for a short while and it is very much unclear whether Alisha didn’t notice that. And the wedding photograph is good evidence to the fact that Wilma may have a share in the land. A thorough search should have taken place in such risky matters which Alisha didn’t. The question is Wilma not being present permanently in the cottage because she was looking after her sick mother which was clearly defined by the case of Chhokar v Chhokar[14]in relation to LRA 1925 were a similar situation has being dealt with. The court of appeal said that it had no difficulty in holding that she was in occupation at the date, and went on to describe her right in the property as an overriding interest. The effect of temporary absence is now being considered by the courts in Link Lending Ltd v Bustard.[15] Occupation of Wilma was obvious enough through the inspection even if Alisha didn’t know about it. This means that provided the occupation is discoverable, the disponee may still be bound by an interest of which she doesn’t know ( Malory Enterprises Ltd v Cheshire [2002] )[16]Nevertheless in Kingsnorth Finance Co Ltd v Tizard[17] provide that there was actual occupation even when the wife was divorced she visited every day to look after her children. Although she was not living there her daily activities might be regarded as sufficient to justify the result. The facts are all important in such a case.[18] The result in Chhokar seems clear, but what if the seller had removed all evidence of the wife. Like in the scenario it is unclear whether Alisha sees possessions of Wilma other than the wedding photograph before sale. And since Bob lies about a divorce Wilma’s claim might be stronger in such a circumstance. The purchaser has a statutory defence to an overriding interest if inquiry is made of the occupier, but the rights are not disclosed.[19] This is a clear hint to a purchaser as to what should be done. Those in actual occupation must be discovered and then asked what their interests are. In practice and in the scenario they tend to rely on the seller’s information. This might be convenient but gives no protection. And when Alisha identified the wedding photograph she should have been careful enough to ask the occupier what their interests are rather than whether she is present or not. This is because there is no need for overriding interest to be the source of the actual occupation.[20] The scenario doesn’t state that Wilma and Bob are divorced so this matter can be taken under Family Law Act 1996, s31 (10), that where one spouse or civil partner owns the family home, the other spouse has a right not to be evicted if already in occupation and a right with a leave of the court to enter and occupy if not already in occupation. And this lasts as long as the marriage continues. Under Sec.31 Wilma’s home rights constitute a charge on the estate or interest of Bob and will bind Alisha in the property for valuable consideration if they are protected by a notice on the register of the title. This acts as an exception to overriding interests and thus binds Alisha. C. Easements and profits can be created expressly or impliedly by granting another person a right over one’s land or by reserving a right over land which one is transferring to another person.[21]Only legal easements are now capable of overriding the register. The LRA 2002 effectively reversed the controversial case of Celsteel Ltd v Alton House Holdings Ltd[22] which held that both legal and equitable easements were overriding within 1925 scheme. But if somehow the deed is registered it loses its overriding status. We can assume that Maxwell’s claim satisfy the requirement for a valid easement as laid down in Re Ellenborough Park.[23]A valid easement can be created by prescription which is long use of land and under Sec 2 of the Prescription Act 1832. The use for many years of a right which is capable of being an easement can create a legal easement by prescription.[24] Prescription arises if an easement has been used openly, as of right, without permission and continuously by one fee simple owner against another, provided that the right could have legitimately been granted by the landowner.[25] Maxwell does use the path openly and even notify Alisha of his right and say he has been using it for any years. It is somewhat unclear whether the prescription is by lost modern grant. Finally, we can come to a conclusion which interests bind Alisha and which does not. The legal lease of Polly doesn’t bind Alisha since there’s lack of physical presence and notice as explained. But the share of Wilma does bind Alisha since she has some equitable rights towards her share of the property. And finally the easement will also bind Alisha through the Prescription Act 1832. Critically examine the rationale for the continued existence of interests which override. â€Å"Overriding interests are important and controversial because they contravene the most basic registration principle: they bind purchasers despite not being entered on the Register† Roger Smith, Elements of Land Law (Pearson Longman 2007) In a sense overriding interests are rather like ‘trump cards’ of the registered land system, taking automatic priority to any rights which are subsequently acquired by a person in the land. Not only that, but they can also lead to alteration of the register with no compensation being payable to the purchase. Little wonder then that a former Chief Land Register referred to them as ‘a stumbling block’.[26] When compulsory title registration was introduced, the aim of its creators was to simplify conveyance by placing all the essential information about an estate in land on a register. Thereafter a purchaser intending to buy the land will only have to look up at the register in order to discover all what he needed to know about the property.[27] A major difficulty arose from the category of ‘overriding interest’. The original notion of land registration was that the register would provide a complete record of the title, so that the purchaser will be able to buy it with minimum or other enquiries or inspections.[28] The fundamental principle behind registered land is the mirror principle, which is to reflect accurately and completely and beyond all argument the current facts that are material to a mans title. Overriding interests represents the greatest breach in the mirror principle. They were not accidentally created but rather deliberately done by the legislature and given automatic effect precisely because they should be obvious to any prospective purchaser or their enforcement is too important to depend on registration.[29] On the other hand the curtain principle is perhaps the most ambitious motive behind the origin 1925 Act and it remains a key principle under 2002 Act. The aim is to keep certain types of equitable interests off the register completely. As Williams and Glyn’s Bank v Boland shows, if the curtain is not raised the purchaser can easily be bound by such equitable interests. This problem clearly involves striking a balance between protection of the purchaser and protection for the occupier of land and it arose largely due to social and judicial changes.[30] Paragraphs 1 to 3 of Schedule 3 cover three types of interests which were overriding under LRA 1925. They are short leases, rights of persons in actual occupation and easements and profits. Schedule 3, Para 1 shortens the length of a lease from not exceeding 21 years to not exceeding 7 years. And in the future it can reduce to 3 years with the effect of e-conveyancing[31]. The reason why these leases override is that it would be unreasonable to expect short leases to be registered and if they were the register would be cluttered up by them. Under the 1925 Act anyone with proprietary right in property and also in actual occupation could claim an overriding interest. In Williams Glyn’s Bank v Boland in 1981 defined actual occupation as â€Å"It is the fact of occupation that matters and what is required is the physical presence in the land and not some entitlement in law†. However, Schedule 3 of LRA 2002 has reduced the extent to which these interests can bind a purchaser on subsequent registration of title so that a purchaser will not be bound if the occupation would not have been obvious on a reasonable inspection of the land at the time of the disposition. Under LRA 1925 s.70 (1) (a) all legal easements and profits and certain equitable easements[32] were overriding. But this wide category was reduced by LRA 2002 under Schedule 3, Para 3 where only legal easements by prescription or implied easements and profits were overriding. The LRA 2002 effectively reversed the controversial case of Celsteel Ltd v Alton House Holdings Ltd[33] which held that both legal and equitable easements were overriding interests within the 1925 scheme. Under LRA 1925 Sec. 70 (1) (f) a squatter could obtain title after 12 years adverse possession.[34] The new rules introduced by LRA 2002 apply to any squatter who had not completed the 12 year imitation period before the Act came into force on 13th October 2003. The rules are designed to protect the rights of the registered proprietor, and as a result the squatter’s chances of acquiring title to land are greatly reduced by the new scheme.[35] Finally local land charges override but they should be discovered by a local land charges search carried out before purchase. Moreover other interests, such as chancel repair liability will cease to override on 13 October 2013. Thus the ‘snap shot’ is becoming more accurate.[36] Why do we have them? At one time it was argued that the register replaces the title deeds and that the registration system should not protect purchasers in respect of interests not generally found in title deeds. Although this seems correct as historical explanation[37], the law commission has rejected it as an approach fit for the modern law. Their view is that, â€Å"In the interest of certainty and of simplifying conveyancing, the class of right which may bind a purchaser otherwise than as the result of an entry in the register should be as narrow as possible but †¦ interests should be overriding where protection against purchasers is needed, yet it is either not reasonable to expect or not sensible to require any entry on the register.†[38] They are also difficult to discover on an inspection of the land.[39] Not surprisingly the 2002 Act is working towards either minimizing or abolishing some overriding interests but has not yet worked out a strategy to eradicate them once and for all.[40] To make them lose their rights would contravene Article 1 of the First Protocol of ECHR. Active promotion of the advantages of registering interests could work in favor of both the purchaser and the beneficiaries of these rights. Times have changed and the importance of moving on cannot be underestimated.[41] This surely illustrates the deepening of the crack in the mirror principle of registered land. In order to narrow the crack, the class of overriding interests may be made more certain by narrowing the class. On the grounds of public policy, there will perhaps always be interests which will need protection against the purchaser, where it will be unreasonable to register the interests. Therefore, the extent of the crack can never really get away from third- party interests, which is just as important as having quicker and cheaper conveyancing. Until legislation makes clear specifications on what particular interests can qualify, the concerns of overriding interests will remain.
